Use of this Site

1. Nationwide News Pty Limited  (News), is the owner and operator of this Site.
2. Each user of this Site (User or you) agrees to be bound by these terms. Your use of and access to this Site indicates your acceptance of and agreement with these terms, as they exist at the time of use.
3. News may amend these terms at any time by posting changes on the Site. News will provide reasonable advance notice of any changes to these terms on the Site which may be detrimental to you. Such advance notice may be provided by posting a notice of such changes on the Site. If you do not agree with the amended terms, you must immediately discontinue your use of the Site. Otherwise, if you use the Site (other than to review the amended terms) after a notice of change has been provided, you will be deemed to have accepted the new terms. News will include on the Site the date on which it last made amendments to these terms.

Content and functionality of the Site

4. News may alter, suspend or discontinue the Site and/or its functionality and/or the content made available through the Site (Content) at any time. Some examples of circumstances where News may do so include to update the Site, to improve the Site’s functionality, to conduct maintenance or improve the security of the Site and due to a change in News’ legitimate business interests, objectives or strategies. To the extent permitted by law and subject to the remainder of these terms, News will not be liable to any User or to any third party should it exercise such rights, except to the extent caused by News’ negligence, fraud or wilful misconduct. Where such actions may result in a change which is reasonably likely to be detrimental to you, News will provide reasonable advance notice of such changes as mentioned above.
5. In some circumstances the Site will allow You to access and download certain content onto Your device(s). Some such Content may not be available at all times in the future for subsequent download and News will have no liability to you in such circumstances subject to the remainder of these terms.
6. News may use automated tools including artificial intelligence tools to assist in creating some Content of, and operating, the Site.

Intellectual Property

7. All intellectual property in relation to content on this Site belongs to News or its licensors, advertisers or affiliates. You obtain no interest in that intellectual property. All content on this Site is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.
8. You may only download and view Content or print a copy of material on this Site for personal, non-commercial use, provided you do not modify the Content in any way (including any copyright notice). All rights not expressly granted under these terms of use are reserved by News. Unless expressly stated otherwise, you are not permitted to copy, or republish anything you find on the Site without the copyright or trademark owners’ permission.
9. The logos of the Site are trademarks of News or one of its related bodies corporate. Other trademarks may be displayed on the Site from time to time. These may belong to third parties. Nothing displayed on the Site should be construed as granting any licence or right of use of any logo, trademark or masthead displayed on the Site, without the express written permission of the relevant owner.
10. You may not use any Content or this Site for any purpose or in any way which is unlawful.
11. You must not access any parts of the Site to which you are not authorised or otherwise attempt to circumvent any restrictions (through exclusionary protocols or otherwise) imposed on your use of or access to the Site.
12. Except as expressly authorized by News, you shall not, nor shall you allow any third party (whether or not for your benefit or otherwise) to frame, scrape, reproduce, modify, create derivative works from, display, perform, publish, distribute, disseminate, broadcast or circulate to any third party (including, without limitation, on or via a third-party website or platform) any Content without the express, prior written consent of News. You shall not – nor shall you make it possible for others to – access, collect, text or data mine any Content from the Site by automated means or any other method, whether directly or through an intermediary, intended to circumvent the prohibitions set out in this clause 11 (e.g., robot, spider, script, service, software or any manual or automatic device, tool or process). For the avoidance of doubt, you shall not use any Content for any machine learning or artificial intelligence (AI) purposes, including, but not limited to, developing, building, training, fine tuning, or grounding or otherwise utilizing Content in any large language models (LLMs), machine learning tools, or generative AI systems. For clarity, your use of our Site and Content is only permitted as expressly set out in these terms and your rights are not expanded, nor are any prohibitions modified or limited, in any way by our use or configuration of exclusionary protocols (e.g., the Robots Exclusion Protocol as implemented through robots.txt files).

No advice

13. Content included on the Site is prepared as general information only. It is not advice and should not be substituted for personal advice which takes into account your individual health, financial or other circumstances.

Liability & Indemnity

14. News does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (Cth) or equivalent State or Territory legislation which cannot be excluded, restricted or modified. To the extent permitted by law, the following provisions apply:
    1. Whilst News endeavours to take reasonable care in providing the Site, News does not warrant the accuracy of the content which you access through this Site. The content is provided to you "as is" and on an "as available" basis. As a result, by using the Site, you agree that you rely on any content on the Site it at your own risk.
    2. News will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your use of or access to this Site, to the extent such loss or damage is not caused by News’ breach of a consumer guarantee, negligence, wilful misconduct or fraud.
    3. News does not warrant that functions of this Site or which you access through this Site, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected, that there will be no technical problems which prevent or unreasonably delay delivery of the Site or any content which ought to be accessible through the Site, or that News or the server that makes it available, are free of viruses or bugs.
15. Subject to applicable law, the liability of News to you for any breach of a term or condition implied by law is limited to the supply of any service again or the payment for the cost of having any service supplied again. However, News cannot limit its liability in this manner if you establish that it would not be fair or reasonable for News to do so or in the event of a major failure (as defined in the ACL) in which case you may be entitled to cancel the services provided to you and receive a pro-rated refund.

Third Party Content & Links

16. This Site may include third party content which is subject to that third party's terms and conditions of use. Nothing on this Site should be construed as granting any licence or right for you to use that content.
17. This Site may include links to third party sites which are not related to News and in relation to which News has no control or interest. News does not provide any representation or warranty about any third party link, third party site or the content which may appear on such third party site. The appearance of those links on this Site does not indicate any relationship between News and that third party or any endorsement by News of that third party, its site or the products or services which it is advertising.

Contributing Content

18. If the Site allows you to submit any user generated content (UGC) in any format, including without limitation graphic, video, audio or text (such as condolences messages and comments to My Tribute notices), you will retain ownership of any content you post. However, by submitting it to the Site, you agree that News can use it and therefore you grant News a non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and display such content on the Site. You irrevocably and unconditionally consent to News performing any act or omission that would otherwise infringe your moral rights (to the extent any exists) in the UGC, including the right to be identified as the author.
19. You warrant that your UGC does not infringe any third party rights, including intellectual property rights, and is not defamatory, obscene, or unlawful, or otherwise contain any derogatory content, including hate speech, racial vilification, or harassment, or is intended to insult, humiliate, or intimidate based on attributes such as race, religion, sexual orientation, or disability. You indemnify News against any loss or damage arising from a breach of this warranty, but not to the extent any loss damage is caused by News’ own negligence, wilful misconduct and/or fraud.
20. You agree that News has no obligation to use or keep your UGC on the Site. News reserves the right, but not the obligation, to monitor, edit, or remove any UGC in its absolute discretion, especially where such content is deemed to violate any News’ policies, applicable law, or creates an unacceptable risk to News or the Site.
21. You are solely responsible for the UGC you post. News does not endorse any opinions expressed in any UGC.

General

22. Users must not use this Site for any unauthorised purpose or in any way which is unlawful.
23. These Terms & Conditions shall be governed by and interpreted in accordance with the laws of New South Wales. Your use of the Site and these terms and conditions are governed by the laws in force in New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales, Australia and the courts of appeal from them.
