Marty Aust SC told the Darwin Local Court on Wednesday he would be writing to prosecutors to say they had insufficient evidence against his client.
The Darwin-based MP, who holds the federal seat of Solomon, is charged with two counts of assault and one of breaching his bail conditions.
He was not required to appear on Wednesday.
The 54-year-old was charged in July with assaulting Northern Territory Administrator David Connolly, the jurisdiction's equivalent to a state governor.
Following a bail breach charge in August, the MP announced he was standing aside as special envoy for defence, veterans' affairs and Northern Australia.
The assaults are alleged to have occurred at the NT Thailand Grand Festival in Darwin on July 18.
On Wednesday Mr Aust said the defence had received 22 civilian statements, one police statement and 19 CCTV files relating to the case.
"We will be writing to the prosecutors on the basis there is insufficient evidence to support the charges."
Mr Aust said he was yet to receive the statements of five witnesses attached to the Thai embassy.
"We are confident they will completely exculpate and prove the innocence of Mr Gosling with respect of count one."
Jo Poole, for the prosecution, told the court that police were still obtaining statements and she would make inquiries about the Thai witnesses.
Mr Aust said no incident was recorded on the 19 CCTV files he had received and of the 22 civilian statements "there is no single eye witness to any event", apart from the administrator claiming he was assaulted.
The administrator's wife put the alleged incident at a different time or place and that has "all the hallmarks of confusion or collusion", he said.
The judge adjourned the matter to November 25.
Prominent Sydney-based barrister Sophie Callan SC has taken on the case against Gosling for the NT Director of Public Prosecutions after the Commonwealth Director of Public Prosecutions declined to take it.
As part of his bail conditions, Gosling is banned from going within 50 metres of the NT's Government House building.
He must give the administrator's office 48 hours' notice before attending any event where the two men would be present.
If they are at an event together, the Labor politician must not be within 15 metres of Mr Connolly.
